This sight is here for the benifit of the entier Kona Garden Estates community.
In a effort to reestablish the fair and lawful teratment of the members of the KGE community by giving members truthful, and lawfull information that will empower them to make intelagent and retional dicisions concerning the care and treatment of the common property of KGE.
KGE has gone Rogue again
KGE Service Corp. has been hijacked by well-meaning members, who, being new here did not know the laws and rules that govern the board’s actions. Instead, they have made up many of their own rules, including now, the newly “revised By-Laws” consequently the board has gone rogue, and altered rules in the boards favor without following the KGE and State laws, crippling the members through censorship of your voice to choose an honest representative.
How? You ask. By changing the by-laws to adversely affect you without your consent as KGE and state laws demand.
They have added special fees and removed all your ownership rights for assessment nonpayment. Your right to a proxy and vote, right to attend meetings, right to be on the board, and the right to request information, records.
Once the false rules and regulations have replaced the actual laws and the board denies transparency, denies any responsibility to resolve any problems that they themselves created, as is the current situation, then the whole thing starts to collapse on the weight of its own misguidance. This creates conflicts, mistrust and laws suits.
Here is a quote from the Rouge board stateing their refusal to resolve any problems on thir own.
12/3/25
“Letters or emails sent to the Board do not constitute a legal dispute and do not obligate the Board to issue any further responses. Any formal legal challenge you wish to pursue must be submitted through your legal counsel and directed to the Association’s attorney at your own expense. The Association will seek recovery of all legal fees incurred in responding to any unfounded or unsupported claims.”
This was the case with the recent lawsuit brought against KGE. According to the plaintiff the board refused to negotiate which resulted in the expensive lawsuit.
